Reporting directly to the Chief Counsel - Commercial, the Senior Counsel will provide solution-oriented legal advice to Mondelez's marketing teams.
Additionally, the Senior Counsel will: (a) serve as the lead business counsel for key brands within the Sweet, Savory, Bars and/or Confectionery categories in the US Marketing organization, and the attorneys for Nutrition/Regulatory and Quality-related matters for the US Business Unit; (b) partner with Scientific & Regulatory Affairs Committee, the Brand Teams, and the Nutrition Strategy, Communications and Quality organizations; and (c) serve on the Core US Special Situations Management Team (SSMT).
Specific responsibilities
Being a commercial legal advisor providing legal thought leadership with an "art of the possible" mindset to support Mondelez International's US Business Unit on its growth journey.
Providing sound legal advice to the Marketing team and supporting functions.
Championing a culture of compliance through advice, communication, role modelling, and training, including implementation of Company policies and their interpretation.
Partnering with management and the Commercial team to keep them abreast of significant decisions, legislation, and governmental regulatory rulings that may affect the Company's regulatory, food law, marketing, and advertising policies and practices.
Designing and delivering training modules for the Commercial team covering a range of topics from advertising, food and marketing law.
Providing legal support on traditional and digital marketing and media strategies including social media, e-commerce, influencer strategies, and compliance.
Partnering with marketing, research and development, nutrition and regulatory in developing and reviewing claims and claims support for products.
Reviewing product advertising, promotional, public relations, packaging, product labeling, co-marketing programs, trade advertising, social media, and general marketing materials.
Negotiating agreements, including licensing, joint promotions, sponsorship agreements, strategic partnership, joint venture, supply agreements, talent agreements, services agreements, and customer/broker agreements.
Providing advice on FDA-related matters, including GRAS notifications, compliance, plant inspections, FSMA requirements, OTC drugs, and NLR requirements.
Managing and providing counsel and guidance regarding pre-litigation marketing and manufacturing disputes; initiating and defending advertising law challenges.
Qualifications & Skills
Juris Doctor with strong academic credentials from a nationally recognized law school.
Licensed to practice law in New Jersey or eligible to become licensed as in-house counsel in New Jersey.
At least 7+ years of experience -- major law firm experience and prior in-house experience preferred.
Strong client counseling and advertising/food law experience, with Consumer-Packaged Goods (CPG) industry experience preferred.
Experience in matters involving food safety preferred and/or working with the U.S. Food & Drug Administration highly desirable.
Excellent management skills and business judgment with a capacity to make timely decisions and give reasoned, competent advice that demonstrates an understanding of overall business objectives and the risks/rewards of each situation.
Exceptional interpersonal skills and the ability to communicate (both orally and in written form) effectively with senior business leaders and other professionals and colleagues at all levels of an organization while utilizing excellent business and legal judgment in complex situations.
Strong ability of leading a team under pressure with demonstrated results.
Efficient, confident, curious, pro-active, attentive to detail, reliable, service-oriented, self-starting, with impeccable integrity and willingness to learn.
